When an organisation engages in the recruitment and selection process, they are usually looking to employ candidates who have specific competencies and fit with the culture of the organisation. 

What many organisations do not realise is that even during the recruitment and selection process, employment legislation applies. It is vital to understand that individuals who have never actually been employed by your organisation can lodge employment tribunal claims. Mistakes in the recruitment selection process are easily avoidable, but once the mistake has been made, it can prove to be extremely costly for an organisation. In the event of a claim against a company, the burden of proof is now on the employer and accordingly it is essential that companies can demonstrate robust procedures and accurate records to show that the recruitment process was fair and equitable and in total compliance with the law.
