It is vital to understand that individuals who have never actually been employed by your organisation can lodge employment tribunal claims. Mistakes in the recruitment selection process are easily avoidable, but once the mistake has been made, it can prove to be extremely costly for an organisation. In the event of a claim against a company, the burden of proof is now on the employer and accordingly it is essential that companies can demonstrate robust procedures and accurate records to show that the recruitment process was fair and equitable and in total compliance with the law.
